Hong Kong Fire Safety Regulations: Common Myths
Whether you operate a shop, rent an office, serve on an owners' corporation or simply live in a building, you are likely to encounter Hong Kong's fire safety regulations. Few people have time to read them in detail, so misconceptions spread: the building's system is sufficient, homes do not need extinguishers, expired units are usable, cheap online products are equivalent, or every venue has the same rules. Prepared by Fire Station, Hong Kong fire extinguisher specialists, this guide examines those myths and cites specific legislation or FSD documents for each point, helping you avoid unintended risks and breaches.
12 myths.
- There are systematic tenants in the building who are responsible to the occupants and the employer for the equipment and staff training in the unit.
- Home use doesn't make fire extinguish ers compulsory, but fire department encourages voluntary setting up.
- The domestic fire extinguish ers are subject to a voluntary exemption in search of an annual check-up from 2024, but not from commercial premises.
- Expiry without a photo application is wrong and is subject to annual inspection and five-year water pressure tests.
- The fire extinguishers are the same as the fire extinguishers on the Internet.
- You have to fill yourself up to be wrong and sign up for the contractor.
- The FS251 is the maintenance company' s fault, it's a legal certificate, it's all there is to it.
- All sites require the same error, depending on the regulations, the licence plates and the risk.
- Numbers of fire extinguish ers are counted in Chapter 502, the number of cards held and the number of fire department files.
- Short-term activities do not address the requirements of temporary licence plates at the same location.
- Chapter s 572, 636 authorize prosecution if a fire safety instruction is received.
- The smoke-resistant wedges and the rear stairwells have no so-called prosecutive reasons at all.

ii. Conversation I: With fire-fighting equipment in the building, the tenant is not in charge?
The myth.
"The building has throats, fire alarms, flowers, fire department owners and administration, and I only rent a unit."
Actual situation
The building's original system is intended for the commons of the building as a whole: corridor larynx, stairwell emergency lighting, fire alarm, detection system.
- O ccupiers: Fire extinguishers set up by license plate or by statute in the unit are generally maintained by the occupants for the same year.
- Employers: The Occupational Health Ordinance requires employers to provide information, guidance, training and supervision; the Labour Department directs requirements for appropriate fire extinguishers and ensures that employees are aware of their location and use.
- Licensed premises: the restaurant, the beauty salon, etc. will be assigned to you by the fire department, and the building equipment will not be included in your license requirements.
- Change of purpose: Change of the office to an exhibition hall, warehouse, studio, fire risk, not necessarily adequate configuration.
What should we do?
Separate the "public sector" from "in-house": first understand what the building has and then assess what is to be added to the unit. See Fire Extinguisher Planning for Shops & Officesand Office Fire Safety Checklist.
iii. Paradigm II: A fire extinguisher for home use is fast enough?
The myth.
"There is a fire department downstairs, so be careful." "and instead, a fire extinguisher is used for himself."
Actual situation
Legally, there is indeed no mandatory requirement for fire extinguishers in independent residential units. However, the Fire Services Department encourages citizens to volunteer fire extinguishers and blankets for their homes, which are generally more suitable for dry powder extinguishers. The reason is simple: from the discovery of the fire to the smoke-filled unit, often only for a few minutes; Prior to the arrival of the fire truck, a fire extinguisher or a fire blanket can handle the most common initial fire alarms, such as barrel fires, soak fires and cooking oil boilers. According to the fire department in 2025, about 42% of the fire alarm in the disaster building was electrical failure, and about 25% was an artificial factor. A lot of it started with the fire.
What should we do?
A 2kg dry powder fire extinguisher is already in basic configuration with a blanket attached to the kitchen entrance. A family choice of 2 kg or less is recommended. More details Home Fire Safety Essentialsgiven Common Causes of Home Fires & Prevention.
iv. Paradigm III: Every year for domestic fire extinguishers?
The myth.
Two extremes: "Doesn't make the Year's Review" and "Doesn't buy it because you're looking for a contractor every year."
Actual situation
This regulation was amended in 2024, with the greatest error. Following the amendment of the Fire Services Department (Equipment and Equipment) Regulations, the citizens were exempted from section 8 (1) of the Regulations for the use of their own (i.e., not in accordance with the law) authorized hand-held fire-fighting equipment.
- Voluntary home setting: The owner does not have to perform the legal duty to maintain the effective operation at all times as well as to be inspected by the registered contractor every 12 months.
- Businesses, restaurants, offices, workshops, building utilities: Not covered by the exemption, annual inspections, water pressure tests every five years, FS251 are still required.
So household use doesn’t surprise us by looking for people, but immunity from legal liability does not amount to incompetence: expired, used, rusty, pressure table deviation.
What should we do?
You can read the pressure table yourself every month; a good year's test date is set by the commercial Fire Extinguisher Inspection & Replacement.
v. Miscretion IV: Fire extinguishers are not used in their appearances, and they are used when they expire?
The myth.
"The barrel has been with me for ten years, and has been fresh, and has not been used, surely it will be of use."
Actual situation
Fire extinguishers are pressured containers. The pressure will run out over time, the dry powder will block, the seal will age and the bottom of the barrel will rust. The Fire Services Department requires the owner to arrange for the registered contractor to check at least once a year and the fire extinguisher to be tested for hydraulic pressure every five years. The Fire Services Department recognizes that the fire extinguisher is marked with the date of production, and that some of the products are valid from the date of production. When the equipment in the commercial premises is not functioning or there is a lack of annual inspection, the fire department may issue a fire-alarm hazard notification or prosecution during the inspection.
Also, expired fire extinguish ers may not be disposed of as ordinary waste: a failed fire extinguisher with chemical substances or pressure is a chemical waste covered by the Waste Disposal Regulations and is to be recovered by the supplier or registered contractor.
What should we do?

VI. Miscrete 5: Is a fire extinguisher bought on the Internet as useful as a fire extinguisher?
The myth.
What difference does it make?
Actual situation
The Fire Services Department (Equipping and Equipment) Regulations, Section 3, requires that all hand-held equipment (hand-held fire extinguishers, blankets, etc.) must be approved by the Fire Services Department Director and may first be supplied or sold in Hong Kong.
- Failure to comply with statutory requirements will not be accepted by the commercial services provider at the time of the annual inspection.
- It's used in the card office. There's a problem with the license application.
- There's no guarantee of quality. There's a real fire that can't be sprayed.
Point identification: the body must be marked with an approval date, date of production and manufacturer; it can be identified using the mobile Fire Services Department application's handheld `sweeping' function, or the list of approved fire extinguishers and blankets published by the Fire Services Department can be checked.
What should we do?
All Fire Services Department Fire Extinguishers & Fire Safety Productsers are approved by the Fire Services Department. Details of the selection are How to Choose a Fire Extinguisher in Hong Kong.
vii. Miscreen VI: Is a fire extinguisher free of pressure?
The myth.
"The pressure sheet fell very little, and it was necessary to find a pump to fill it." "And it was used little, and some powder went on."
Actual situation
Installation, maintenance, repair and inspection of firefighting installations and equipment shall be performed by a registered fire-fighting contractor ; Hand-held fire extinguishers fall within the scope of a level 3 contractor. Self-pressure may exceed the design pressure; Pressure drops are mostly the ageing of the seals, and cleanliness does not solve problems. Qualifications include depression, valves, internal wall checks, resealed, fire extinguishers to specifications, pressure, leak detection, labelling, hairing FS251.
What should we do?
If you are well-equipped, you can fill it with a contractor; if you are damaged, you can change it. It is usually more cost-effective to replace a household tube directly. Fire Extinguisher Servicing or Replacement.
viii. Myth 7: FS251 is the maintenance company's file, not me?
The myth.
"I don't know what it is after the inspection of the paper."
Actual situation
FS25 1 is the "Certificate of Fire Protection Devices and Equipment", a statutory document. After the registered contractor has completed the installation, maintenance, repair or inspection, a copy shall be sent to the client within 14 days and sent to the Fire Services Department. The Fire Services Department has launched the FS251 online delivery system and introduced a 2D code against forgery. This certificate proves that your equipment was in normal operation at the time of inspection.
- Evidence from the fire department during the inspection.
- Applications for licence plates are made for the same renewal documents.
- The insurance claim is certified as having performed due diligence.
- Records of lease disputes.
What should we do?
After each annual inspection, an original or a copy of the FS251 is kept and archived with the fire extinguisher list and the water pressure test records.
ix. Paradigm 8: All sites have the same fire-fighting requirements as last time?
The myth.
"This is the last time we've been together, and this time we're going to copy it."
Actual situation
Fire safety requirements are influenced by a number of factors, and different combinations can be significantly different:
| Factors | Point Impact |
|---|---|
| Building type is the same age | The building on or before 1 March 1987 may be regulated by Chapters 502, 572 or 636 with instructions for improvement |
| Same registration for use | There are rules from the fire department for food, public entertainment, Kara, school, and the home. |
| Area | Chapter 502 specifies the commercial premises so that 230 m2 is bounded and fire extinguishers are counted per 100 m2 |
| Risk position | The kitchen boiler requires UL-300 automatic fire suppression systems; an additional fire extinguisher for each larynx on the electric charger floor; and CO2 for the server room |
| Existing equipment in the building | Places with larynx systems, number of fire extinguishers in Chapter 502 not applicable |
| Management Service requests with owners | The mall, the industrial management company may have a single model co-location requirement. |
What should we do?
Each project is new: lower the type of building, age, size, purpose, licence plate, existing equipment, and then find a contractor to evaluate it. Fire Extinguishers for Car Parks & Industrial Buildingson Customer Fire Safety Case Studies.
X. Miscreen IX: How many fire extinguishers do you need?
The myth.
"Four doors will suffice."
Actual situation
Some of the statutes are counted as follows:
- Chapter 502 provides for commercial premises (banks, off-site betting stations, jewellery and gold shops, supermarkets, department stores, malls, etc., over 230 square metres): ( b ) A minimum of one hand-held fire extinguisher per 100 m2 and 100 m2 for less than 100 m2; Not applicable where a fire hose reel system has been installed. Example: 350 m2 with no larynx at least 4
- Card-held: The Fire Services Department issued regulations on individual meals indicating 9 litres of water extinguishers, CO2 extinguishers, and 1.44 square metres of blankets for fire suppression; The Fire of Places with Cards is defined as a general diet of 9 litres of water or 5 kilograms of dry powder per 100 square metres of seat, with one fire-fighting blanket per oven.
- Card-based cooking: one 2.5 kg dry powder fire extinguisher per 100 m2 per seat, plus one in the VIP room.
- Electric vehicle charging garage: one additional dry powder or CO2 extinguisher at each larynx setting point on the charged floor.
- Other premises: assessed by registered contractor by size, risk and code.
What should we do?
The documents required for arrival at the Fire Services Department or Management Service are accompanied by documents; the contractor is asked to evaluate them if they are not available. Fire Extinguisher Planning for Shops & Offices.
xi. Meth 10: Short-term activities, fairs, Pop-up, fire-fighting?
The myth.
"Pop-up buys fire extinguishers for a week or two."
Actual situation
- Registration plates for temporary public entertainment venues: exhibits, performances, carnivals, fairs, etc., are to be requested. The fire department will conduct on-site inspections and risk assessments, issue fire safety regulations and generally require the proportional placement of authorized hand-held fire-fighting equipment (e.g. 9 litres of water, 4.5 kg CO2), open passages and no fire-dissemination on the site.
- Temporary food manufacturing plant license plate: The sale of food at a temporary stand during a public event is required for a period of not more than seven days, subject to the requirements of the Fire Services Department.
- Local co-insurance: the mall, the reception hall and the studio usually require the operator to prepare and present a certificate for the fire extinguisher.
- Refur bishment: Labour Department guidelines require suitable fire extinguishers to be provided at the workplace.

12-Throughth 11: Getting fire safety instructions, delay?
The myth.
"The people of the Fir'aun (Fahd al-Alam) have not met, but they have done it before." "The owners of the works are many, and they have no answer."
Actual situation
Cap. 572 covers composite and domestic buildings built on or before 1 March 1987. Cap. 636 covers industrial buildings of the same period and came into effect on 19 June 2020. They empower the Fire Services Department and Buildings Department to issue Fire Safety Directions requiring owners to improve equipment such as sprinklers, hydrants, hose reels, fire detection, emergency lighting and extinguishers. Failure to comply can lead to prosecution. In recent years, the FSD has inspected high-risk buildings, issued Fire Hazard Abatement Notices and brought prosecutions.
The legislation allows some flexibility. For target buildings of six storeys or fewer under Cap. 572, the FSD accepts an Internet of Things fire detection system together with portable extinguishers as an alternative to hose reels and manual fire alarm systems under Circular No. 3/2026, with a considerably lower cost.

XIII. Miscreen XII: The smoke-resistant wedge is open and the rear stairwells are placed in the shoe cabinets?
The myth.
"Weeds open smoke-proof doors to facilitate access." "There is no one on the back stairs, and there is no problem with putting a shoe cabinet."
Actual situation
According to the Fire Department, the prosecution of the old building was based on smoke-proof door violations , followed by obstruction of escape routes , followed by fire-fighting equipment violations. During the inspection by the fire department, it was found that the escape route had been blocked or locked, smoke-proof doors opened or damaged, fire-fighting installations had failed or there had been a lack of annual inspection, and that a fire-alarm hazard notification or prosecution had been issued. In September 2026, the Fire Services Department conducted an inspection of eight high-risk buildings in plain clothes and prosecuted the opening of smoke-proof doors and the way to prevent escape.
The reason is good: smoke-proof doors are open, smoke is pouring into the escape stairwell, and the people in the building have no way out; the back stairwells are filled with miscellaneous items that both prevent flight and fuel.
What should we do?
The smoke-proof doors remain closed but cannot be locked; the corridors, the back stairs, and the roof exits do not contain any miscellaneous items; and the Closers fail to report immediately to the Administration. See Common Fire Safety Equipment in Hong Kong Buildings.
XIV. STAFFING OF RESPONSIBILITIES: WHAT ARE THE RESPONSIBILITIES OF THE OCCUPIED, THE JAPANESE, THE CORPORATES AND THE EMPLOYMENTS?
| Item | General party responsible | Legal basis |
|---|---|---|
| Annual inspection and maintenance of fire-fighting installations (throws, alarms, flowers, emergency lighting) for the public part of the building | Owners, members of the judiciary, management companies | Chapter 95B, article 8; Building deeds |
| Improvement of fire safety instructions in the old building | Owners (owners, legal corps) | Chapters 502, 572, 636 |
| Fire extinguishers set by license plate or by statute in the unit | Occupant (depending on the lease) | Article 8 of Chapter 95B; licensing conditions |
| Fire training for employees, fire extinguisher positions are the same | Employers | Chapter 509; Labour Department guidelines |
| Fire equipment configuration of licensed premises | Holder | The fire department's regulations. |
| Voluntary home-based fire extinguishers | Households (exemption from statutory annual inspection) | Chapter 95B revised 2024 |
| The smoke-proof doors are closed and the fire escape is open. | All of them; I'm in charge of inspection. | Chapter 95 Eliminating Fire Risks |
| Discharged fire extinguisher | Owner to supplier or contractor | Chapter 354 |
The lease may be subject to a different agreement, prior to the signing, to ask for the same year's inspection of the fire equipment in the responsible unit.
Frequent issues FAQ
There's a fire-fighting system in the building. Are the tenants out of control?
Nope. The responsibility for the larynx, alarms and flowers in the common part of the building lies with the owner, the Legion of Laws or the management company, except that fire extinguishers in the Tenant's unit, which are based on licence plates or regulations, are generally the responsibility of the occupier, Card-held places such as catering are more structured according to the rules issued by the Fire Services Department. The Department of Labour ' s Fire at Work Guidelines also require employers to provide suitable fire extinguishers and ensure that employees are aware of them.
Do Home Extinguishers Need Statutory Annual Inspections?
Following the amendment of the Fire Services Department (Equipment and Equipment) Regulations, 2024, the household voluntarily installed (not as provided for by law) approved hand-held fire-fighting equipment for residential use, Exemptions are subject to the same legal duty to operate effectively at all times and to be inspected by a registered contractor every 12 months. Businesses, restaurants, offices, and the public part of the cosmopolitan building are not exempt.
Can fire extinguishers that have expired or have no annual check-ups be used?
Shouldn't be. The Fire Services Department requires that fire extinguishers be inspected by a registered contractor at least once a year and every five years for water pressure tests. Pressure drains, dry powder blocks and the ageing of seals can invalidate fire extinguishers. When the commercial premises fail to function or there is a lack of annual inspection, the Fire Services Department may issue a fire-alarm hazard notification or prosecution. Fire extinguishers are chemical waste and are to be recovered by suppliers or contractors.
Can you use the fire extinguisher you bought on the Internet?
Under section 3 of the Fire Services Department (Equipment and Equipment) Regulations, all hand-held fire extinguishers and blankets must be approved by the Fire Commissioner for supply or sale in Hong Kong.
FS251 is what? Which one?
FS251 is a certificate of fire-fighting installations and equipment issued by a registered fire-fighting contractor within 14 days of completion of installation, maintenance, repair or inspection. Send a copy to the fire department. All premises where fire-fighting installations are provided for by law (businesses, restaurants, offices, works, building utilities) should be provided with FS251 after the annual inspection.
How many fire extinguishers do you want?
Depending on the type of place. The Fire Safety (Commercial Places) Ordinance (chap. 502) provides for at least one hand-held fire extinguisher per 100 m2 (less than 100 m2) on the floor of the commercial premises. However, the fire hose reel system is not applicable. Card-holders are configured according to the regulations issued by the Fire Services Department for individual locations. Other premises are subject to risk assessment by the registered contractor.
Can a Fire Safety Direction Be Ignored?
No. Cap. 572 covers composite and domestic buildings built on or before 1 March 1987, while Cap. 636 covers industrial buildings of the same period. These ordinances empower the Fire Services Department and Buildings Department to issue Fire Safety Directions requiring owners to improve Fire Services Department installations and equipment. Failure to comply can lead to prosecution. Contact registered contractors and an authorised person to address the requirements within the specified deadline.
What's the consequence of the smoke-proof door wedge opening and putting the shoe cabinets on the back stairs?
The fire department states that the most common reason for prosecution in the old building is smoke-proof door violation, followed by blocking the escape route.
It is true that Hong Kong's fire regulations are not simple, and small-scale owners and tenants do not necessarily have time to study each other, but they can avoid two extremes: "no" and "no" and "no". Bearing in mind the following key figures : Chapter 95B, Article 3 ( to recognize), every 12 months (annual inspection), every 5 years (water pressure test), 14 days ( FS251), every 100 m2 ( Chapter 502), 1 March 1987 (old building boundary), It's much safer than most of the "hearing."
